Terms of Service

1. Agreement to Terms

By downloading, installing, or using the Brisyn Focus application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and VAZQUEZ LOPEZ ALEJANDRO ISAAC (operating as "Brisyn Focus") regarding your use of the App.

2. Description of Service

Brisyn Focus is a productivity application that provides:

  • Pomodoro timer with customizable focus and break sessions
  • Task management and organization tools
  • Gamification features including XP, levels, and achievements
  • Wellness features including streak tracking and habit counters
  • Cloud synchronization (Brisyn Pro subscription required)

The App is available on Android, iOS, macOS, Windows, and Linux platforms.

3. User Accounts

3.1 Account Creation

To access certain features (including cloud sync), you must create an account using a valid email address. You agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access
  • Accept responsibility for all activities under your account

3.2 Account Termination

You may delete your account at any time through the App settings. Upon deletion:

  • Your cloud data will be permanently deleted within 30 days
  • Local data remains on your device until you uninstall the App
  • Active subscriptions must be cancelled separately through your payment provider

4. Subscriptions and Payments

4.1 Brisyn Pro Subscription

Brisyn Pro is available through:

  • Monthly subscription: $39 MXN per month
  • Annual subscription: $199 MXN per year (58% savings)

4.2 Payment Processing

Payments are processed securely through Stripe. We do not store your credit card information. All transactions are subject to Stripe's terms of service.

4.3 Cancellation and Refunds

  • You may cancel your subscription at any time
  • Your Pro features remain active until the end of the current billing period
  • No partial refunds are provided for unused time
  • Refunds may be granted at our discretion for technical issues

4.4 Price Changes

We may modify subscription prices with 30 days notice. Price changes take effect at the start of your next billing cycle.

5. Acceptable Use

You agree NOT to:

  • Use the App for any illegal purpose
  • Attempt to gain unauthorized access to any part of the App or its systems
  • Interfere with or disrupt the App or its servers
  • Reverse engineer, decompile, or disassemble the App
  • Remove or alter any copyright, trademark, or other proprietary notices
  • Use the App to transmit malware, viruses, or harmful code
  • Harass, abuse, or harm other users
  • Create multiple accounts to abuse free features

6. Intellectual Property

6.1 Our Rights

The App, including its code, design, text, graphics, logos, and all other content, is owned by Brisyn and protected by copyright, trademark, and other intellectual property laws.

6.2 License to You

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

  • Download and install the App on your devices
  • Use the App for personal, non-commercial purposes

6.3 Your Content

You retain ownership of your data (tasks, notes, etc.). By using cloud sync, you grant us a license to store and transmit your data solely for the purpose of providing the service.

7. Data and Privacy

Your use of the App is also governed by our Privacy Notice, which is incorporated into these Terms by reference. Key points:

  • Free users: Data stored locally on your device only
  • Pro users: Data synchronized to encrypted cloud storage
  • We do not sell your personal information
  • You have rights to access, correct, or delete your data

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Implied warranties of merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy or reliability of results
  • Uninterrupted or error-free service

We do not guarantee that the App will meet your requirements or that defects will be corrected.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BRISYN SHALL NOT BE LIABLE FOR:

  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or use
  • Damages arising from loss of productivity data
  • Damages exceeding the amount you paid to use the App in the 12 months preceding the claim, or $100 USD, whichever is greater

This limitation applies regardless of the legal theory (contract, tort, negligence, etc.) even if we were advised of the possibility of such damages.

10. Indemnification

You agree to indemnify and hold harmless Brisyn, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Content you create or share through the App

11. Termination

We may suspend or terminate your access to the App immediately, without prior notice or liability, for:

  • Violation of these Terms
  • Fraudulent or abusive activity
  • Non-payment of subscription fees
  • Any reason at our sole discretion

Upon termination, your right to use the App ceases immediately. Provisions that by their nature should survive termination (intellectual property, liability, indemnification) will survive.

12. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Mexico, without regard to conflict of law principles.

Any dispute arising from these Terms shall be resolved in the courts of Mexico City, Mexico. You consent to the exclusive jurisdiction of these courts.

13. Changes to Terms

We may modify these Terms at any time. Changes will be effective immediately upon posting the updated Terms. We will notify you of significant changes through:

  • In-app notification
  • Email to your registered address

Your continued use of the App after changes constitutes acceptance of the modified Terms.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

These Terms, together with the Privacy Notice, constitute the entire agreement between you and Brisyn regarding the use of the App, superseding any prior agreements or understandings.
